Introduction

Welcome to DARSHAN VENTURE. These Terms & Conditions (“Terms”) govern the access, usage, and interaction with the services, applications, websites, communication platforms, WhatsApp Business messaging services, Rich Communication Services (“RCS”), and associated digital solutions provided by DARSHAN VENTURE, having its registered address at 112, MUTHA ARCADE, SATARA, RAJPATH, BHAVANI PETH, SATARA – 415002, India.

By accessing, browsing, registering, subscribing to, or using any service offered by DARSHAN VENTURE, you acknowledge that you have read, understood, and agreed to comply with these Terms, including all policies referenced herein.

These Terms are designed in accordance with applicable Indian laws, including the Information Technology Act, 2000, applicable rules thereunder, and digital communication compliance requirements associated with Meta Platforms, Inc., WhatsApp Business Policies, and RCS messaging standards.

If you do not agree with any provision of these Terms, you must discontinue use of the services immediately.

Definitions

For the purposes of these Terms:

  • “Company”, “We”, “Us”, or “Our” refers to DARSHAN VENTURE.
  • “User”, “Customer”, “Client”, or “You” refers to any individual, business, organization, or entity using our services.
  • “Services” means all digital services, messaging services, communication tools, software solutions, APIs, automation systems, and related products offered by DARSHAN VENTURE.
  • “WhatsApp Official API” refers to the official business messaging platform provided through Meta-authorized infrastructure.
  • “RCS” means Rich Communication Services supported through telecom operators and approved communication platforms.
  • “Platform” means the website, application, portal, dashboard, or communication interface managed by DARSHAN VENTURE.
  • “Content” means messages, files, data, text, images, audio, video, documents, and communication material shared through the services.
  • “Applicable Laws” means laws, regulations, governmental directives, and industry standards enforceable in India.

Acceptance of Terms

By using the services of DARSHAN VENTURE, you confirm that:

  • You are legally capable of entering into binding agreements under Indian law.
  • You are authorized to represent any business or organization on whose behalf the services are used.
  • You agree to comply with all applicable laws, communication regulations, anti-spam requirements, and Meta Business policies.
  • You understand that continued use of the services constitutes ongoing acceptance of these Terms.

DARSHAN VENTURE reserves the right to suspend or terminate access if any violation of these Terms is identified.

Description of Services

DARSHAN VENTURE provides digital communication and business messaging-related services, which may include:

  • WhatsApp Official API integrations
  • RCS messaging services
  • Customer communication tools
  • Automated messaging systems
  • Business communication management
  • Campaign management services
  • Notification delivery systems
  • CRM and communication integrations
  • Business verification assistance
  • Technical support and onboarding

Services may evolve, expand, or change over time based on operational, technological, legal, or compliance requirements.

DARSHAN VENTURE reserves the right to modify, discontinue, suspend, or enhance any service without prior notice.

Eligibility

To use the services provided by DARSHAN VENTURE:

  • You must be at least 18 years old.
  • You must possess legal authority to enter into contracts.
  • Businesses must provide accurate organizational information.
  • You must not be prohibited from using digital communication services under applicable laws.

Use of the services by minors, fraudulent entities, or unauthorized persons is strictly prohibited.

Account Registration

By registering an account, you agree to:

User Responsibilities

  • Use the services for phishing or deceptive practices.
  • Violate intellectual property rights of others.

Users are responsible for obtaining valid opt-ins and consent from recipients before sending communications through WhatsApp or RCS platforms.

Failure to comply may result in immediate suspension or permanent termination of services.

Payment & Billing Terms

Users agree to pay all applicable charges associated with the selected services, subscriptions, messaging usage, setup fees, or platform fees.

Payment obligations include:

  • Timely payment of invoices.
  • Payment through approved payment methods.
  • Compliance with applicable taxes, GST, duties, or governmental levies.

DARSHAN VENTURE reserves the right to:

  • Revise pricing structures.
  • Introduce new fees.
  • Suspend services for overdue payments.
  • Recover unpaid dues through lawful means.

Unless otherwise stated, all payments are non-refundable.

Any disputes regarding billing must be reported within seven (7) days of invoice issuance.

Subscription Renewal & Termination

Subscription-based services may renew automatically unless cancelled prior to the renewal date.

DARSHAN VENTURE reserves the right to:

  • Suspend accounts for policy violations.
  • Restrict services due to non-payment.
  • Terminate services for unlawful conduct.
  • Discontinue inactive accounts.

Users may request cancellation by contacting the official support channels.

Termination does not relieve the user from outstanding payment obligations.

Use of WhatsApp Official API & RCS

Users acknowledge that WhatsApp Official API and RCS services are subject to third-party platform rules and telecom regulations.

Users specifically agree to:

  • Follow Meta Business Messaging Policies.
  • Maintain valid recipient consent records.
  • Avoid unsolicited promotional messaging.
  • Respect recipient opt-out requests.
  • Use approved templates where required.
  • Avoid prohibited business categories.

DARSHAN VENTURE does not guarantee continuous availability of WhatsApp or RCS services because such services depend on third-party infrastructure providers, telecom operators, Meta platforms, and internet availability.

Users understand that Meta, telecom operators, or regulators may independently suspend messaging capabilities for policy violations.

Message Delivery & Compliance Policy

DARSHAN VENTURE strives to facilitate reliable message delivery; however, message delivery may depend on:

  • Telecom operator availability
  • Recipient device compatibility
  • Internet connectivity
  • Third-party platform restrictions
  • Government regulations
  • Meta approval systems

DARSHAN VENTURE does not guarantee:

  • Instant delivery
  • Delivery success rates
  • Read receipts
  • Recipient engagement

Users must comply with:

  • Anti-spam regulations
  • Data privacy requirements
  • Consent obligations
  • Platform messaging limitations

Any misuse may lead to account restrictions and reporting to relevant authorities.

Intellectual Property Rights

All trademarks, service marks, software, branding materials, logos, content, designs, documentation, and platform technologies associated with DARSHAN VENTURE remain the exclusive property of DARSHAN VENTURE or its licensors.

Users are granted a limited, non-exclusive, non-transferable right to use the services solely for lawful business purposes.

Users shall not:

  • Reverse engineer software
  • Copy platform architecture
  • Reproduce proprietary materials
  • Resell services without authorization
  • Modify or distribute protected content

Unauthorized use of intellectual property may result in legal action.

Confidentiality

Both parties agree to maintain confidentiality regarding sensitive business information shared during the course of service usage.

  • Financial details

Confidential information shall not be disclosed except:

This obligation survives termination of services.

Disclaimer of Warranties

The services provided by DARSHAN VENTURE are offered on an “as-is” and “as-available” basis.

DARSHAN VENTURE makes no warranties regarding:

  • Continuous availability
  • Error-free operations
  • Uninterrupted service
  • Specific business outcomes
  • Compatibility with all devices
  • Guaranteed delivery rates

To the maximum extent permitted under Indian law, all implied warranties including merchantability, fitness for a particular purpose, and non-infringement are disclaimed.

Limitation of Liability

To the fullest extent permitted by law, DARSHAN VENTURE shall not be liable for:

  • Indirect damages
  • Loss of profits
  • Business interruption
  • Data loss
  • Reputation damage
  • Messaging failures
  • Third-party platform restrictions
  • Telecom outages

Total liability arising from any claim shall not exceed the amount paid by the user to DARSHAN VENTURE during the preceding three months.

This limitation applies regardless of the legal theory asserted.

Indemnification

Users agree to indemnify and hold harmless DARSHAN VENTURE, its directors, employees, affiliates, agents, and service providers against claims, damages, liabilities, costs, or legal expenses arising from:

  • Violation of these Terms
  • Breach of applicable laws
  • Improper use of messaging services
  • Unauthorized communications
  • Intellectual property infringement
  • Violation of third-party rights

DARSHAN VENTURE reserves the right to assume exclusive defense in matters subject to indemnification.

Governing Law (India)

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the jurisdiction of competent courts located in Maharashtra, India.

Users agree to attempt amicable resolution before initiating formal legal proceedings.

Changes to Terms

DARSHAN VENTURE reserves the right to modify these Terms at any time.

Updated Terms may be published on the official website or communicated through digital channels.

Continued use of the services after updates constitutes acceptance of revised Terms.
